Last updated September 10, 2023 Welcome to Books Beyond Shelves (“Portal”), a platform that facilitates the borrowing and lending of children’s books. These Terms of Use (“Terms”) govern your access to and use of the Portal. By accessing or using the Portal, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Portal. Supplemental terms and conditions or documents that maybe posted on the Portal from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of these Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically rereview these Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms by your continued use of the Portal after the date such revised Terms are posted.

User Eligibility

The Portal is intended for individuals who are at least 18 years old or who have obtained the consent of a parent or guardian. By using the Portal, you represent and warrant that 1) you have the legal capacity and you agree to comply with the Terms; 2) you are of a legal age to form a binding contract

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Portal (or any portion thereof).

User Registration

In order to access certain features of the Portal, you may be required to register an account. You agree to provide accurate, current and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. You agree to immediately notify the Portal administrators of any unauthorized use of your account or any other security breach.

User Obligations

You agree to use the Portal solely for its intended purpose of borrowing and lending children’s books. You shall not use the Portal to engage in any illegal or unauthorized activities, including but not limited to the distribution of offensive, harmful, or infringing content. You shall not interfere with the proper functioning of the Portal, attempt to access any unauthorized areas, or use any automated means to collect data from the Portal. You shall comply with all applicable laws and regulations while using the Portal.

Books Listings and Exchange of Books

Users may list children’s books they wish to lend on the Portal. By listing a book, you represent that you are the rightful owner of the book and have the authority to lend it. Users are responsible for accurately the required details of the books they list. Users agree to comply with lending and borrowing agreements made through the Portal, including promptly preparing the agreed upon books in the provided bag for pick up and notifying the Portal upon completion. The Portal does not guarantee the availability, quality or condition of any listed books.

Intellectual Property

The Portal and its content, including but not limited to text, graphics, logos and software, are protected by intellectual property rights and are owned or licensed by the Portal administrators. Users shall not reproduce, modify, distribute, or otherwise use any copyrighted material without the explicit permission of the respective right holders.

Privacy

The collection and use of personal information on the Portal are subject to our Privacy Policy. You can refer to it under ‘Privacy Policy’.

Disclaimer of Warranties

The Portal is provided on an “as-is” and “as-available” basis without any warranties or representations, express or implied. The Portal administrators do not guarantee the accuracy, reliability or completeness of any content on the Portal or the availability or functionality of the Portal itself.

Limitation of Liability

In no event shall the Portal administrators be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the Portal.

Modifications and Termination

The Portal administrators reserve the right to modify, suspend or terminate the Portal or any part thereof, at any time without notice. These Terms will remain in effect until terminated by either you or the Portal administrators.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
